A. When does the law of negligence apply?

Negligence can arise in many everyday settings. Common examples include road traffic accidents, unsafe workplaces, defective buildings or falling objects, unsafe products, medical treatment, and professional advice. ​ 

 

Negligence commonly applies to civil claims involving personal injury and damage to property. It can also arise in areas such as medical negligence, professional negligence, employers’ liability, occupiers’ liability, and road traffic accidents. In each case, the plaintiff must prove that the defendant’s lack of reasonable care caused the loss or injury complained of.
