B. Injunctions

Injunctions are equitable and discretionary remedies used to prevent ongoing or threatened interferences: 

 

  • Prohibitory injunctions: Restrain the defendant from continuing or repeating a trespass. 
  • Mandatory injunctions: Compel the defendant to perform a positive act, such as pulling down an encroaching structure. 
  • Quia timet injunctions: Granted to prevent a threatened trespass that has not yet occurred, provided the threat of damage is imminent and substantial.
