D. Mesne profits
A claim for mesne profits is a specific action for damages for the defendant's wrongful use and occupation of land. It is often joined with an action for the recovery of land. This claim is most commonly used against a tenant who refuses to vacate premises after their lease has ended.
The measure is generally the market rental value of the property during the period of trespass, even if the plaintiff suffered no actual financial loss or the trespasser derived no actual benefit.
