3. Error of law

An error of law which proves decisive may lead to the quashing of a decision. An example of this would be the misinterpretation of statutory provisions which leads to an erroneous outcome. For example, in Kwan Shung King v Housing Appeal Tribunal [2000] 2 HKLRD 764, the decision to evict a father for his son’s acts was quashed by the court since it was held that the decision-maker erroneously treated the son’s friend to be “family or servants” under a public tenancy agreement.
