IV. Grounds of judicial review

In the following sections, various “grounds” of judicial review will be briefly introduced.  However, it must be noted that the “grounds” of judicial review are not watertight compartments because the various grounds for judicial review run together.

 

The exercise of power for an improper purpose may involve taking irrelevant considerations into account, or ignoring relevant considerations; either of which may lead to an irrational result. The failure to grant a hearing to the affected person would be in breach of principles of procedural fairness, and may result in a failure to take into account relevant considerations.  Hence, often times a discernible “error” involves multiple “grounds” which will be explained below.
