3. Consequences of non-compliance with procedure

There is currently no specific law that governs the procedures of conducting an identification parade. However, the Force Procedures Manual includes a Code of Practice that provides guidance on conducting identification parades. The Police General Orders state that the Force Procedures Manual offers information, advice, and guidance on various procedures.

 

While a failure to follow the guidelines outlined in the Force Procedures Manual could result in disciplinary action for a police officer, it does not inherently render the identification evidence inadmissible in court. The key issue is whether the defendant has been prejudicially treated.
