D. Punishment

Under section 40 of the Offences against the Person Ordinance (Cap. 212), anyone convicted of common assault is guilty of a criminal offence. The maximum penalty for common assault is up to 1 year in prison.

 

Under section 41 of the Ordinance, upon conviction, the court may, in addition to imposing any penalty, order the offender to enter into a recognizance, with or without sureties, in a sum not greater than $500, to keep the peace or to be of good behaviour for a period not exceeding 12 months.
