Civil litigation may become necessary where the responsible party denies liability, refuses access, fails to repair the defect, or where the affected owner seeks compensation for damage and loss.

A water seepage claim may be brought against an owner, occupier, tenant, Incorporated Owners, management company, contractor or other responsible party, depending on the facts.
