i. Why expert evidence matters
Water seepage problems can be technically complex. Water may travel through cracks, construction joints, conduits, concrete weaknesses, or other hidden paths before appearing in another unit.
Expert evidence assists the court in answering questions such as:
- Where did the water come from?
- What route did the water take?
- Was the leakage caused by defective waterproofing, pipe leakage, drainage defects, or other building defects?
- What repair works are necessary?
- Has the nuisance stopped after repairs?
- What damage was caused, and what is the reasonable cost of reinstatement?
Because these issues require technical knowledge, expert evidence is usually indispensable in water seepage litigation.
