b. Expert evidence

Expert evidence is often crucial in water seepage disputes. It helps the court identify the likely source of seepage, assess the path of water penetration, determine the appropriate remedial works, and quantify loss or damage.

In most cases, visual inspection alone is not enough. Courts generally regard mere observation as unreliable for proving the source of water seepage. Professional assessment by a building surveyor, engineer, or other suitably qualified expert is usually required.
