g. Building managers or property management companies
The building manager or property management company is usually responsible for day-to-day building management, inspection, repair coordination, and maintenance of common facilities. Its duties normally arise from the DMC, management agreement, or instructions from the Incorporated Owners.
A management company may be joined as a defendant if it is alleged to have failed to take reasonable steps to manage, inspect, repair, or arrange repair of the relevant common parts or facilities. However, its duty is generally not absolute. The question is whether it did what was reasonably required of a competent building manager in the circumstances.
For example, liability may arise if repeated complaints were made about seepage from a common pipe and the manager failed to investigate or report the matter to the Incorporated Owners. On the other hand, if the manager acted promptly and reasonably within its authority, liability may not arise.
