The Civil Service Regulations (CSR) govern the government workforce.
CSR 940 (Medical Board):
If a civil servant is suspected of being unfit due to mental or physical health, the management convenes a Medical Board. The Board assesses whether the officer is permanently unfit for service. If so, they are “invalided” out of the service.
A civil servant against whom an order appointing a committee to manage his/her affairs under Part II of the Mental Health Ordinance would essentially be automatically referred to a Medical Board. The legal inability to manage affairs is incompatible with the discharge of public duties and the handling of public resources. This leads to termination of service via medical retirement.
