Arson
A person commits arson if he commits criminal damage by means of fire (See section 60(3) of the Crimes Ordinance). The elements of offence are the same as criminal damage, save that the damage is done by fire.
The maximum sentence for arson is imprisonment for life. There is no sentencing guidelines for arson, but the courts generally regard arson as a serious offence given the inherent danger in any uncontrolled fire. The seriousness and circumstances of the case will be considered, where the defendant’s personal background or young age may not be a strong mitigating factor.
