Using a False Instrument/a Copy of a False Instrument

A person who uses an instrument which he knows or believes to be a false instrument, coupled with the intention of inducing somebody to accept the instrument as genuine and to be prejudiced would be guilty of using a false instrument under section 73 of the Crimes Ordinance (Cap. 200). 

 

Examples would include using a falsified medical report for a job or sick leave application, using a falsified cheque to withdraw money or using a forged credit card. 

 

It is no defence that the person used a copy of the false instrument instead of the original. Under section 74 of the Crimes Ordinance (Cap. 200), it would still be an offence to use a copy of false instrument. 

 

The maximum penalty for using a false instrument or a copy of false instrument is 14 years’ imprisonment.
