7. What must an expert report contain?
An expert report must comply with the formal requirements under the RHC or RDC and the Code of Conduct for Expert Witnesses.
The report should include:
- the expert’s qualifications and experience;
- the facts, materials and assumptions relied upon;
- the reasoning leading to each opinion;
- any range of opinion on the issue, where appropriate;
- any matters that could affect the reliability of the opinion;
- a declaration that the expert has read the relevant Code of Conduct, understands the duty to the court and has complied with that duty; and
- a statement of truth signed by the expert.
The expert’s duty continues after the report is served. If the expert later changes his opinion on a material matter, he must inform the instructing party and provide a supplementary report without delay.
