A. Drunkenness
Under section 28(1) of the Summary Offences Ordinance (Cap. 228), a person found drunk in any public place, or on premises licensed under any Ordinance relating to liquor licences, is liable to a fine of $2,000.
Under section 28(2), a person who, while drunk, behaves in a riotous or disorderly manner in any public place is liable to a fine of $2,000 and imprisonment for 2 months.
Under section 28(3), a person found drunk while in charge of a vehicle (e.g. a bicycle, cart, or rickshaw), other than a motor vehicle, or a horse, in any public road or street, is liable to a fine of $2,000 and imprisonment for 2 months.
Drunkenness while in charge of a “motor vehicle” is governed by the Road Traffic Ordinance (Cap. 374).
For this purpose, a person is deemed to be drunk if he is so much under the influence of alcohol as to have lost control of his faculties to such an extent as to be unable to perform the relevant activity safely.
