C. Touting

While section 6 of the Summary Offences Ordinance (Cap. 228) focuses on the noise and cries themselves, section 6A specifically targets “touting”.

Under section 6A, a person commits the offence of touting if, in a public place, he importunes another person to buy any article or thing, or to give custom to any business, in a way that annoys or is likely to annoy that other person. On a first conviction, the penalty is a fine of $1,000. On a second or subsequent conviction, the penalty is a fine of $2,000 and imprisonment for 6 months.

The word “importunes” means soliciting pressingly or persistently. Merely approaching someone once and leaving after refusal may not necessarily amount to touting if the conduct is not annoying or likely to annoy.
