3. Can a custody order be varied?

A custody order can be varied by the court. The parent or guardian who is making the application for variation of custody must be able to show that there is a material change of circumstance that requires a change in the existing custody arrangements.

The court will regard the best interests of the child (who is under the age of 18) as the first and paramount consideration when deciding whether to vary a custody order.
